Once a purchase is completed, you will have access to the digital content or service, and we cannot issue a refund. Digital Content & Right of Withdrawal: By accessing or downloading digital content, you expressly consent to immediate performance and acknowledge that you lose any applicable statutory right of withdrawal once delivery of the digital content has begun. This includes, but is not limited to, accessing course materials, viewing lessons, or starting assessments.
Nothing in this section is intended to override any mandatory consumer protection rights, including statutory cooling-off or refund rights, that may apply in your jurisdiction.
All content, features, and functionality of MedComic, including but not limited to text, graphics, logos, images, comics, illustrations, and software, are owned by GradeShark LLC and are protected by copyright, trademark, and other intellectual property laws.
Your Content: You retain ownership of any content you submit, post, or display through the Service, including but not limited to messages, comments, profile information, and any other materials (“User Content”).
License Grant: By submitting User Content, you grant GradeShark LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and otherwise exploit such User Content solely for the purposes of operating, improving, and providing the Service. This license continues until you delete the User Content or your account, except where the content has been shared with others and they have not deleted it.
Content Removal: MedComic reserves the right to remove or disable any User Content at any time, for any reason, without prior notice. We are not obligated to store, maintain, or provide you with a copy of any User Content.
No Preservation Obligation: We are not responsible for preserving, maintaining, or providing copies of any User Content. If your account is terminated or deleted, your User Content may be permanently deleted without recovery. You are solely responsible for maintaining your own backup copies of any User Content you submit.

A purchase grants you access to content as it exists at the time of access, not a guarantee of perpetual availability of any specific materials. We reserve the right to update, improve, or restructure content in the ordinary course of operating the Service.
MedComic is delivered using the GradeShark platform, a third-party technology service. While GradeShark provides the underlying technology infrastructure, GradeShark is not a party to your relationship with MedComic and is not responsible for the content, services, or transactions provided through MedComic.
Any issues related to content, purchases, or account access should be directed to MedComic at the contact information provided below. GradeShark, as the technology platform provider, shall not be liable to you for any claims arising from the content or services provided by MedComic.
We may terminate or suspend your account and access to the service immediately, without prior notice, for any reason, including if you breach these Terms of Service.
Upon termination, your personal data will be handled in accordance with our Privacy Policy, including deletion of account data within 30 days of request.

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF GRADESHARK LLC EXCEED THE GREATER OF FIFTY DOLLARS ($50.00 USD) OR THE TOTAL AMOUNT YOU HAVE PAID TO MEDCOMIC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THE LIMITATIONS OF THIS SECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, AND WHETHER OR NOT GRADESHARK LLC HAS BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE.
You agree to defend, indemnify, and hold harmless GradeShark LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney’s fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms of Service; (c) your violation of any third-party right, including without limitation any intellectual property, property, or privacy right; (d) any claim that your User Content caused damage to a third party; or (e) any activity under your account, whether or not authorized by you.
GradeShark LLC shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic or epidemic, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, third-party service provider outages (including cloud hosting, payment processors, and content delivery networks), cyberattacks, or any other force majeure event.
We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through our platform. Continued use of the service after changes constitutes acceptance of the new terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. GradeShark LLC is a limited liability company registered in the State of Florida. You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Service shall be brought exclusively in the state or federal courts located in the State of Florida, and you consent to the personal jurisdiction of such courts.
Any dispute, controversy, or claim arising out of or relating to these Terms shall first be attempted to be resolved through informal negotiation. You agree to contact us at [email protected] before initiating any formal proceedings.
If the dispute cannot be resolved through informal negotiation within thirty (30) days, either party may pursue resolution through the courts as specified in the Governing Law section above.
Severability: If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be modified and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions shall continue in full force and effect.
Entire Agreement: These Terms, together with the Privacy Policy and any other legal notices or agreements published by GradeShark LLC on the Service, constitute the entire agreement between you and GradeShark LLC concerning the Service. These Terms supersede any prior agreements or understandings between you and GradeShark LLC relating to the Service.
The failure of GradeShark LLC to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by GradeShark LLC.
